Our team contributes to the European Commission's new guidelines on dominant conduct
On 31 October 2024, the Institute of Legal Studies submitted comments to the European Commission on the draft Communication "Guidelines on the application of Article 102 of the Treaty on the Functioning of the European Union to abusive and exclusionary conduct by dominant undertakings". Annija Skrule of our office was involved in the preparation of these comments in cooperation with Assistant Professor Lauris Rasnačs and lecturers Patrīcija Bodniece and Zanda Dāvida.
This Communication will be an important guidance instrument for EU competition law, clarifying the criteria for establishing and assessing dominant positions in relation to exclusionary conduct. It will replace the 2009 Communication and bring the standards up to date in the work of the European Commission and national competition authorities.
